PET LAWS IN INDIA WHICH ANIMAL LOVERS SHOULD KNOW:

According to section 11(3) of the Prevention of Cruelty to Animal Act 1960 – It is not legal for housing societies to approve resolutions prohibiting pets from living in apartments, which address the requirements of pet owners.

Based on this act several apartment complexes are implementing pet-friendly regulations. Supporting it is Article 51A(g) of the Indian Constitution, which explains every citizen must have compassion for animals and other creatures and maintain the natural environment. Pet owners in fact must follow the municipal sanitary by-laws or other regulations such as the SPCA (Society for the Prevention of Cruelty to Animals). In addition to that in the year 2020 July, the Karnataka government issued a circular outlining a specific set of instructions for resident welfare associations and flat owners associations for the protection of pets and stray animals.

A few major laws from India’s animal welfare board that pet owners should be aware of

● A restriction on having pets cannot be imposed by society through law changes.
● Having pets is a fundamental freedom provided to an Indian resident.
● Pet owners are not breaking any municipal laws by having their pets in their flats.
● An aggressive attitude towards a pet is not permitted.
● RWAs (Resident Welfare Associations) cannot prohibit pets from using lifts.
● Dogs can’t be kept out just because of the barking sound.
● The associations or society cannot make any judgements about the size or breed of dogs.

Even after the Animal Welfare Board of India has outlined the legalities and policies around the keeping of pets in residences, pet policies for apartments may differ depending on the building (or) location.

Pet parents can look for an apartment community with pet-friendly amenities such as a private garden, pet space, a larger balcony so they can get some fresh air, and so on.

Some of the best apartment communities may even have pet parks, community dog runs, and so on. Make sure your pets have enough space and are at ease in their surroundings.

Although no law forbids dog owners from keeping their pets, there are certain basic guidelines that they must follow.

Dos:

● Check to see if the breed or type of pet you choose is suitable for your way of life.
● Train your pet to not emit cries of distress if you leave them home alone.
● To avoid upsetting other people, let your pets relieve themselves in the same place each day. Utilise a trash scooper to clean up after your dogs.
● Use a leash when walking your pet on the grounds or in public spaces to ensure that they don’t cause a disturbance in the neighbourhood.
● Verify that your pet’s vaccines are up to date. Particularly when there are young children present, neutered animals are more docile.

Don’ts:

● Before leasing or purchasing an apartment, remember to read the restrictions.
● Your pet can react negatively if you allow the kids to taunt it. Make sure you train them well.
● Always abide by the apartment’s pet policy; never attempt to conceal or keep pets without permission.
● Due to hygienic and property concerns, do not bring your pet to the pool
● Do not reward persistent barking or meowing. By giving healthy distractions like toys or taking the animals for a stroll, correct their behaviour.
● Don’t rule out professional training if your dog displays aggressive conduct. It has to be corrected.
